Am i wrong - covid related.

Good afternoon everyone. I booked my wedding for April 2021 and had paid my deposit to my photographer. I was about to send in my deposit for the venue but I didn’t do so because Covid had began to run rampant here in New York. But I did secure my photographer because I didn’t want him to get booked. In the midst of all of this mess with the pandemic I lost my job, furloughed in March and essentially laid off in June therefore not being able to save the required funds for our wedding. I reached out to the photographer to ask if I could get my deposit back since I’m not able to reschedule at this point because we don’t know if the venue was going to allow us to do so also we didn’t have the means to finance it because we lost our jobs due to the pandemic. I asked for the full deposit but I also said if that was unreasonable if I could get back half the deposit since the unemployment came as A result of a global pandemic. I did not hear back anything from this photographer not even an acknowledgment of my email. My question is am I wrong for requesting that back? Should I have gotten back my deposit? This is probably a reach.

    I would check out your contract. If the contract states that the deposit is non-refundable, then the photographer is not required to give you any amount of money back.

    It never hurts to nicely ask them if you can get your deposit back on the off chance that they'll agree, but if it's in your contract that the deposit is nonrefundable, then they are not obligated to give anything back.

    If your contract says the deposits are non refundable then unfortunately they aren't obligated to give you anything back. Definitely check your contract. Hopefully he/she will offer a refund even if it isn't the full deposit

    It depends on what your contract says. It your contract indicates that your deposit is non-refundable then you wouldn't be entitled to a refund.

    You’re not wrong for wanting your deposit back if you want to cancel the booking and won’t be using the photographer’s services, BUT, it doesn’t mean they will accede to your request.

    Unless your contract with the photographer has a change of mind/cancellation policy, or a good force majeure clause, the return of your deposit will be at the mercy of your photographer’s discretion.

    It never hurts to ask, but it is within the photographers rights to keep the deposit. A deposit is usually nonrefundable and is the fee for holding a date open for you and therefore losing other potential business that day as a result if you cancel. As it is their main source of income, they also likely need it to live as their employment was also impacted by pandemic. Unfortunately it seems to be lose/lose scenario for all in this situation. You can always check the terms of your contract just in case.

    Most of my contracts didn’t say anything about a pandemic 😂 so I also asked. Some have it back, some partial, a few of them just are holding onto it for me to use for another time and like the situation your in some people literally did not reply at all! I wish they would at least say no instead of not saying anything. Sorry all of this is happening. Wishing you the best of luck

    @Madison...exactly. Doesn’t say anything about a Pandemic or anything. I am bug on customer service and to not even acknowledge my email is a no. So I’ll take the L but best believe I will be leaving my “updated” review here and on Google. And what’s sad is I really loved his work.

    Thank you everyone. The contract is very basic and says nothing about pandemic or any other anything. I wasn’t expecting the full deposit but I figured I would ask for at least half of it due to the situation. But the fact that he didn’t even acknowledge my email or respond and give me a know or anything is what completely turned me off. I’m an entrepreneur in a business owner myself and I value customer service above everything and for me I will not patronize or give you my money regardless of how good your product is based on how you treat me once you have my money or in that process. So I am going to update my review here on WW as well as on Google. I’m just gonna take the L and that’ll be it and it’s sad because he has really good work and was giving us a great deal. But I am sure I can find another just a good in my area.

    Hi Latonya!

    I'm so sorry to hear about how you've been impacted by COVID. I would recommend checking your contract, many of my vendors said that the deposit is non-refundable if I were to cancel. Many of my vendors have been great since I had to postpone my wedding, but have not required me to pay anything additional. I hope it all works out for you! Please update us!

    I wrote a review regarding my vendor/photographer and he reached out to me. We talked it over and honestly he’s going to still continue to be my photographer and I am going to use him when we decide to reschedule which probably won’t be until 2022 since our numbers here in New York State are skyrocketing past what it was when the pandemic started.
