2020 Brides help!!!!
I’m getting married August 1st, 2020 but my entire wedding plans are now changed and we’re just having an intimate ceremony and dinner celebration. My venue has been so hard to contact, I’ve called for days and finally today got in touch with someone. Prior to today everytime I tried to speak with someone all they would tell me is “by August it’s expected to have 100 guests so we’re still keeping August events” - in addition 08/01 has a special meaning to us so that’s why we were so persistent on getting married that day. Anyways today I talk to my venue and we’re now only allowed 50 guests due to state restrictions - my venue proceeds to tell me I’m not getting a refund (which I expected) & I am also required to pay 60% of our contracted amount if I cancel. I am cancelling bc we already have new plans that work with COVID restrictions.
BUT 60%?!!?!?!?! I looked at my contract and it does state that if we cancel we would owe 60% but this is a different situation, we are in a pandemic!!! I am so devastated and upset over this and I can’t even imagine having to pay them over $10,000 when we have lost out on so much money throughout this entire wedding planning changes due to covid. How would you proceed?!?? Help!!!

    If ur paying anyway cant you just have the 50 guests at your original venue ?

    I'm so sorry Brandi, but legally you're both held to what is in that contract. Like Queen Cone said, are you open to using your original venue for 50 guests? Or can you reschedule with your venue for a large celebration later next year?

    If I were you I would consult with an attorney. There could be various claims that you could make against the venue such as unjust enrichment. Basically the venue is not entitled to your money because they did not perform any services required under the contract. To allow the venue to keep your money would "unjustly enrich" them. Also, the fact that the contract is drafted by the venue and you did not likely have a lawyer review it before signing it then the contract may be read in a light favorable to you.

    My venue is trying to argue that they can hold my wedding in Port Jefferson on 8/29/20 because they have a restaurant on the premises and so they allege that they can operate at 50% capacity. I have received an email from NYS advising that weddings are non essential social gatherings and are therefore limited to 50 people maximum. I am arguing with them because my contract contains a 150 person minimum and about half my guest list is from out of state, mainly from states that would have to quarantine if they came to New York. On July 20, 2020 they demanded my June payment that had been postponed in June until we had additional guidance. I wrote back to the venue saying that it is illegal for them to hold my wedding so I would not be making the June payment. I have not heard from them since. But they do still have almost $20,000 of my money.
