Contract question

I am about to sign our contract, and they were really good about writing in the contract we will receive our deposit back if Covid-19 interferes. But there is still that clause that’s in almost every contract that basically says the venue can cancel for ANY reason and we will not get our money back. But if we cancel, they keep our money. Huh?? Sorry, there’s nothing you can say to convince me that’s fair. We had a horrible experience with our last venue before this where they screwed us over so I really want this one to be VERY clear and make sure we are protected. Is there anything I can suggest to them to amend this clause so it is more fair to both parties or to make sure I am protected?

    Ask them to remove that clause. All they can do is say no and you’re in no different position than you are now.

    Yup, they should remove that... so if they choose to close down then you don’t get your deposit? Doesn’t make sense.

    Wow, that sounds incredibly one-sided! None of the contracts we’ve signed have had that clause in there. If our vendors cancel, we get refunded all monies paid to them.

    Definitely get that part removed, I have never seen that before. It definitely wasn't in any of our contracts

    I agree with the previous comments - definitely ask to get that part removed. That's extremely unfair to you that they can cancel on you for any reason AND keep your money. If they won't remove it, I would find a different venue.

    Did you mean to say in your post that if the venue cancels your contract you will not get your money back? Because if so, then that's not a legit vendor and I would not hesitate to run away.

    If the contract is they can cancel and you will receive your money back I think that's fine, but you could definitely ask them to remove it. Honestly that's not a clause I've ever seen a venue have, because that's bad business, so I'd still be hesitant with this venue.

    Thats what I was thinking when I read it. Infact my contract with my venue says all my deposits are non refundable, however if they have to cancel for any reason (including bankruptcy) I get all monies paid to date back. There is no "COVID" clause though, pretty much is a wedding can be held even if it's not ideal (guest limit/no dancing etc) I can't cancel.
