Coronavirus Refund - Italy Wedding Venue Deposit/laws

Hello,


I paid a deposit that was non-refundable for my wedding venue at a hotel in Positano. I also have a deposit for my hotel stay there.


They have referenced "article 88 of law-decree no. 18/2020 and article 28 of law-decree no. 9/2020" to give me a voucher for the hotel stay, but does anyone have any idea what the laws might be to try to obtain the venue deposit back?


It was a short contract with these terms: "In case of cancellation for any reason, the deposit will be nonrefundable and non-transferable."


I understand the terms - this was not an event we'd ever cancel for any reason we'd hope to get the deposit back except this pandemic's circumstance that has affected everyone. I'd like to be able to apply the costs to the next time we replan our special day.

    You need a lawyer for this. We will not be able to adequately help you on here.

    That said, I took a look into the decrees you mentioned. It looks like it was an emergency order by the Italian government allowing hotels and such to offer vouchers instead of the refunds they normally would be obligated to give you. This is in conflict with EU laws, but that is likely to result in a long court battle before it is decided whether they can hold or not.

    Your contract sounds like the venue deposit can't be used toward another date, but you might have some wiggle room. In U.S. contracts this is known as a Force Majeure clause.

    But again, you need a lawyer.
