Creating a new last name

Pheonix, on March 10, 2021 at 9:51 AM Posted in Family and Relationships 0 13
My fiance and I have kind of decided on changing our last name to be something completely new when we tie the knot. My last name is pretty bland and his last name has connections to it that he would like to be separated from. Has anyone on here done that before? How much harder is it than just switching to his last name?

I think it’s more difficult for him that for you. Name change due to marriage is different processing than just changing your name. I’d try to talk to someone at the social security office as that’s the first step in name change either way.

This may sound dark but . . I think as long as he doesn't have any felonies on his record it should be an easy process.

Hahaha! No he doesn't it's more his family's background. He always gets asked if he was related to Warren Jeffs and polygamy stuff which he isn't associated with but because of his last name, people assume he is

I know one of my teacher's in high school did this. I don't know how difficult the process is, but social security should be able to talk you guys through the steps if you give them a call.

I mean, technically his would be changing due to marriage too wouldn't it? It could be just as simple.

That’s a good point. Maybe? Although I’d assume there are some archaic sexist rules that may only apply to the woman but very good point it could be just as simple!

Most states will require one of you to petition the court for a legal name change. Depending on your state, this can be a fairly lengthy process and it does cost money. Then the other person can just change it after the wedding.

Too true. Some days I momentarily forget that we live in a hellish, patriarchal society. You're probably right that they'd pull something like that though.

I know different areas are different, but in my county you only have specific options for what a new name can be. This is from my county's website following the Name Equality Act of 2007:

Each party to the marriage may adopt any of the following last names:

    - The current last name of the other spouse.

    - The last name of either spouse given at birth.

    - A name combining into a single last name all or a segment of the current last name or the last name of either spouse given at birth.

    - A combination of last names

You'll need to check in your area and see what restrictions like that may exist. It shouldn't be any harder than just switching one last name in theory, except that in this case both of you would need to deal with changing our names with the Social Security department, on your driver's license, credit cards, bank accounts, etc.

My husband changed his last name before the wedding. Granted, he changed it to his dads name we didn’t make one up. He had to petition the court and go in front of a judge. It was an easy process and I imagine changing it to a new made up name would be the same process.
My husband said the judge said as long as it wasn’t completely ridiculous you could pretty much change it to what ever you want. We’re in Tennessee and I’m sure each state is different. More than likely he would have to change his name before the wedding so that it was an easier process for you. If he doesn’t cha he it before the wedding, you will both have to petition the court and pay all the court fees associated with changing it. (I think he paid $250)
