Help- i want to break a contract with my hair and makeup artist!!!!

So my hair and makeup artist is apparently very reputable and talented. But I have an issue with her inability to respond to me in a timely matter. I do not care about losing my deposit money, but I signed a contract for my wedding at the end of May 2020.

The contract is very vague and I am extremely nervous about asking her about cancellation because I cannot afford to lose $600+ on services which aren't even performed. The contact confirms that the deposit is nonrefundable but the contract is not clear about the remainder in the case of cancellation. The way that it is worded is that it is up to the discretion of the artist...

BACKSTORY:

I signed a contract and sent her my deposit via VENMO with her but did not hear back from her for 8 days after multiple attempts to contact. I had to email her twice, once the day I paid and again 8 days later. I sent her one or two texts just to let her know I would like to set up my trial now that I had paid her. And when she wasn't responding, I saw she posted on instagram asking for brides to get "prebooked for that month". So I messaged her on instagram saying "hey I paid you, I would love to get set up. I want to make sure you have received my money as well." When I did this, she finally responded to my text and we got it all figured out.

Between that two week gap of my contact with her and trail, she must have not officially opened my instagram message because she replied back and said she would like to email me her bridal prices... Which I had to respond and tell her I am already a paid client.

She was super nice in person and she listened to adjustments I requested during my trial. I had no issue there. I messaged her when I got home to let her know, "Thank you so much, etc etc etc, but hey my eyebrows were a bit thick and I was curious if I could send you pics of how I usually do them so we can make them more similar to that for the day of wedding makeup!" She never responded, ok fine. I give it about a week or so later, and write her to ask what time we should get started for day-of-wedding services and no response. It has been 5 days since I wrote her asking about that. So yesterday I sent another text. Nothing. Around midnight I sent a very polite email.

I honestly really want to cancel with her but I do not want to be held responsible for the remaining balance as I cannot get ahold of my artist!

I honestly do not know what to do and it is really stressing me out. ADVICE??

    Unless the contract specifically states it, she can't hold you responsible for the cost of the services if you cancel.

    Hmmm I see why you would be concerned and a bit upset about this.. I agree with PP — you shouldn’t be responsible for the cost of the services if you are canceling - obv you won’t get your deposit back but that’s not an issue you said — 😬🤷🏼‍♀️

    Hello and thanks for your response, the contract does say I am responsible for the remainder unless the artist, at her sole discretion, excuses the remaining balance.

    If she is unwilling to excuse the balance, of course I will just work with her despite the stress that it causes. But I am nervous about causing that awkward tension of asking her to cancel, being told not without penalty, and then having her do my hair and makeup with that tension.

    I have been extremely understanding and polite, but I don't know how to even ask her for a cancellation at this point because of the contract.

    If you’re this upset about it where you want to cancel, and rightfully so I mean this chick can’t even send you an email or text back, then if she refuses to return your deposit depending on your bank and if you paid with a credit card or debit card I would just contact your bank and file a complaint and they will typically reimburse your card. I would then obviously find a new hair and make up stylist and ask for references before signing a contract.

    I am okay with losing my deposit because she did my trial, so she should be paid for that!! However, I do not want to be held responsible for the very large remaining balance! With the contract, she has the ability to take me to small claims court. However, I doubt she honestly would. ALSO I WOULD LIKE TO ADD SHE STILL HAS NOT EVEN SIGNED OUR VIRTUAL CONTRACT. but in the state of colorado, this does not make a difference as I am still legally bound because I have signed it

    I would email her letting her know that due to her poor and unprofessional communication, you have decided to break your contract with her and move on to another hair and makeup artist. Go ahead and say that you understand you will be forfeiting your deposit, which you are fine with, but you are not okay with her lack of communication. I would leave it at that and see what she says. I would not ask about owing anything else or bring it up. She may just let you go because she is still getting your deposit and you are calling her out on being unprofessional. But you are doing the right thing by firing her!

    Yeah I hear ya, I mean it would honestly be much more of a hassle for her to take you to small claims court but if she ends up doing so then you can just blast her all over social media and review sites. The loss she will incur due to the bad reviewsIs definitely not even worth the money that she would be potentially charging you if she continued to pursue with any sort of legal action if you choose to not go with her.     I would call her, not text or message and/or go there in person. Explain to her the lack of communication is concerning, and you would like to discuss your trial. Lack of response upsets me too, and while I understand people are busy, and I am not their only bride, I do expect some sort of response in a relatively timely manner. Sounds like you’re giving her plenty of opportunity to respond. Have you already paid everything off? If you cannot get a hold of her, I would follow up as others have said, and say that due to lack of communication you would like to break your contract. Even if she takes you to court - which is time and money - you could fight it and say that you made multiple attempts to reach her, with no communication in return. I recommend keeping every single email and text you have sent, and once you (hopefully) get a hold of her, follow everything up with email so it is in writing. “Just following up from our phone conversation today that my trial is set for xx date.” Something along those lines with everything. It creates a good paper trail if it came down to court.

    Is she independently employed or does she work for a salon?

    I was super frustrating trying to schedule my HMUA but the salon she works at recently got a new software system in place and it turned out I just needed to contact the salon directly instead of trying to book with her. I emailed the salon and got crickets, but it turned changes to the website that were made to integrate the new software scheduling system was spitting emails into the ether. Once I got the right email/phone number I've had excellent service. My old hair stylist I would just text to set up and appointment, and my FH's barber is the same way so it was a learning curve for me to effectively book at the new salon.

    Hi am sorry, who was your hair and make up person. i have exactly the same problem. I was wondering if perhaps its the same person. i dont know what to do.
