Make up artist refusing to return deposit

I had to reschedule my wedding due to Covid, and now with a new wedding date , my make up artist is unavailable for the new date. She also refuses to give me back my deposit. No service was rendered. What options do I have? She did email me a contract and I did not get a chance to sign it before my venue ran out of business and had to reschedule. I do however, have email conversations and that she agreed the deposit would go towards the new date.

I would look at the contract and see what it says, or do you mean you gave her the deposit without a contract? I'm not a lawyer, but if you did decide to take her to court, it will be the contract that determines things, I would think. If you don't have a signed contract, I'm not sure what you can do.

If you have a contract with her, see what it says about refunds/rescheduling. If you gave her a deposit without a contract, it’s going to be much harder. But even with a contract that states the deposit will go towards a new date in the event of cancellation, it will likely fall on you to pick a date that works with her schedule.

Thanks everyone for your help. Update: She finally got back to me after 3 weeks and it’s settled and I got my deposit back. Thank goodness. And happy planning yalls.
