Marriage license Destination wedding

Sarah, on June 17, 2024 at 10:27 AM Posted in Planning 0 3
Hi everyone, getting married in Hawaii and live in socal. My brother is officiating the wedding. I’m reading up on marriage licenses and that whole process, I’m wondering if it’s smarter to get a marriage license here or in Hawaii. If anyone has insight on this please speak into this! Anything helpsSmiley smile

You can call the clerk in a clerk for the marriage licenses here to get more direct information. I suspect however that getting the marriage license within a state requires that all aspects be within the state's jurisdiction: the approval of the officiant, the application for license being done in the state, and the marriage event. The reason for this would be that if a marriage were faked that state would have jurisdiction over all parties involved.

The way marriage licenses work is, you have to obtain the license and file it in the state you are married. So, if you plan to be married in Hawaii, you would first need to ensure your brother’s ordination is recognized in Hawaii. If it is, you would then need to go to the courthouse and apply for a marriage license. Your brother would then sign it right after your ceremony, and he would need to physically take it to the courthouse in Hawaii and file it.
The other option (which many people who have destination weddings choose to do) would be to have your Hawaiian wedding just be symbolic, and get legally married in your home state before you leave, or when you return.

If you get married in Hawaii, you have to get a marriage license there. If you get a marriage license in your home state, you’d have to have the legal ceremony in your home state. That’s the *legal* ceremony. It’s possible to have that as just a clerk’s office wedding with you and the minimum required witnesses, then you have the show wedding in Hawaii. Only you can decide if you’re okay with that.
