Marriage License - K1 Visa

Hello! I’m honestly not sure if someone can help me or
not.

My fiancé is from England and is here on a K1 visa. We went and applied for him to get a SSN on May 17. They have to verify his documents with DHS before issuing a number.

Everything I’ve read states that foreign fiancés on visas do not need to have a social security number to get the marriage license, they just need to show proof of being here legally (I94, K1 Visa, Passport). However, my local town office (in Maine) is refusing to give us a marriage license without his SSN. It can take 4 to 6 weeks to get an SSN (from what I’ve seen) and we want to get legally married June 26.

Is my town office correct in refusing to give us a marriage license? I’m stressing out because the wedding is in 4 weeks and 2 days and I don’t know if he’s even going to have his SSN by then. Does anyone have any experience with this?

    I would speak to an immigration lawyer in your state. I’m not sure whether your office is right for refusing the marriage license, but the best thing you can do is consult a professional who would have the answers and be able to guide you on what you can do if the office refusing you is incorrect.

    I don't know about Maine, but in NC when you do not have a SSN you need an affidavit and then you can apply for a marriage license. But I agrre with PP talk to a professional! Each state is different with its proceedings!

    You'll need a lawyer, each state is different. In MA you cannot get one without a SSN, it caused a lot of heartbreak for my friend and her husband who also had a visa. Rhode Island on the other hand will give you a marriage lisence without one, be sure to have your lawyer check neighboring states and see if you can transfer the lisence in after.

    Better to talk to a lawyer, but a quick internet search says the requirement is a federal law and that a foreign citizen can show their documents and not provide an SSN - ME supposedly got rid of its state requirement for an SSN in 2012. It’s possible that this info is wrong/out-of-date, but I strongly suspect the clerk you talked to was wrong. Have you tried raising the issue to the clerk’s supervisor?

    I agree about asking a lawyer. Since you don’t have much time, go on Avvo.com & there you can ask immigration lawyers in your state this question for free & get an answer in few days.
    Another option is to get expedited SSN issued. Depending on your state, they can expedite process for a small fee.
