Marriage License when you're getting married out of state

Nia, on July 4, 2017 at 3:31 PM Posted in Planning 4 35

My SO and I live in Arizona, but are planning on being married in Texas. Somehow, I cannot find any definitive answer online to whether we would be getting a marriage license for our state or residence or for the state we are being married in. From what I hear, it can vary state to state. Does anyone have any experience with this?

This information is readily found online. All states require that you obtain a marriage license from the state in which you will be married.

You get your license in the state you get married in. But different states have different requirements as if you have to get it in the county you get married in or not. They also have different windows of time that you have to get your license and still have it be valid on your wedding day.

We're getting married in IA, but live in MO. Iowa's licenses are valid for six months so we got ours back in April even though we werent getting married until July.

You get your license in the state where you will be married. There is only one state that is an exception and I can't remember which one it is.

Also note that a Texas marriage license is not valid until 3 days after you receive it (meaning you need to get it at least 4 days before your ceremony), and it expires on the 90th day after receiving it if you have not had your wedding yet. So keep that timeline in mind when deciding when to actually go and apply for the license.

In Florida, the 3-day waiting period only applies to FL residents -- not non-residents. License is good for 60 days and must be returned to the courthouse within 10 days after the wedding. The license can be obtained at any FL county courthouse and used anywhere within the state.

You need someone who can legally bind you as husband and wife in the state you will be married in. The only thing you need is your drivers license but make sure you check how long you have to wait before collecting your marriage license.

You get the license in the state in which you're getting married. It doesn't always have to be from the county you're getting married in though. Check the laws in the state you plan to marry. In the state we got married, we could get a license from any town clerk in the state since we weren't residents of the state. Also, much to my surprise, they required no forms of identification, not even a driver's license. I'm sure that's an anomaly though.

Don't go by anything you hear here. I can't even give you definitive information about NJ; for example, some offices require divorce decrees, some don't. Some offices have a three week waiting period to even apply for your license.

Call the actual office that will be issuing your license in Texas and ask exactly when you need to apply and exactly what to bring.

Sovatastic, not every state goes by county. In NJ, we go by city. We could be the only state, but it's worth talking to the horse's mouth, as it were.

Yes we are from MA but recently moved to SC and will be having the wedding in MA so we actually have to take a short trip up right before the wedding to get our license in time for the wedding.

I'm from Texas& getting married in Texas as well. From what we were told Texas goes by the county. Prices also vary, like Celia and others have said though it's definitely worth calling the court house to check though(:

In FL, the fee can vary slightly by county because each county gets to decide their own sales tax rate in addition to the state sales tax.

In FL, you have to produce official photo ID (state ID card or drivers license or passport), they will want to know the date your last marriage ended and your SSN.

We got our marriage license from the state we were married in. (Married in Florida but live in Wisconsin). You can contact the court house. We had to call for a guaranteed answer.
