Name Change x2

My husband & I got married in 2020, after our marriage license was issued, my husband went through the process to change his last name to his father’s (it’s a long story). That was always the plan, I’ve wanted to carry on his father’s last name. Now I want to take his name too, however the social security office won’t allow me to change my name as a married person because our marriage license / certificate has his old last name on it. I brought in his name change documents as well (something the social security office told me to do on the phone) and they won’t accept it. Now our only options are to divorce and get remarried, or spend another $2,000 and many months to go through the same process he did to change his name.


Is there an easier way? Why is it you can hyphenate you name get rid of your middle name and yet I still can’t change my married name??

    I think it varies based on where you live. 2000 seems way high though! I wonder if there is a way to get a new marriage certificate with his new name? I'm sure you've thought of basically everything, but I just want to say I'm so sorry that this is so annoying and I hope you can get it worked out!

    He should have changed his name before getting the license. You will have to go through the same process he did. Petition the judge and pay the name change fees.

    The name change process outside of marriage window will vary greatly by jurisdiction. Most places require a court petition (which involves time and money). I can't imagine that there would be an easier way for you than the options you have been given by your local registrar/court.

    It's totally dependent on your state laws, but changing your name outside your marriage window is long and arduous, sometimes expensive, although 2K seems way out of left field. For example, in Iowa it's $200 (even CA is max $480), you file a petition and then do paperwork. Getting divorced and remarried seems way, way more complicated.

    I also know it's too late to do this now, but there should've been the option for both of you to change your name at the time of the wedding. You can change it to literally whatever you want, the only part thats easier is you get to do it for free. You still have to go through all the other paperwork with SS, DMV, etc.

    Edit: Oh, I see now he changed his even after the marriage, that really complicates it even more. Also, changing a last name is such a big deal because it's the tie to your entire legal identity. It may be easier to just socially go by your husband's name and legally have it be your maiden.

    I've heard this is possible in some states. In others you can't have duplicate marriage certificates.

    Name changes are differentdependingon where you live. We forgot to get our new hyphenated name on the marriage certificate and BOTH had to do a name change with the court but it was only $30 each of us. After we had the official Name Change Order from the court, Social Security gave us no problem changing our names.
