Non refundable contract

Hello! I apologize in advance for this long discussion topic. We met with a bakery yesterday for a tasting. I was so excited about the opportunity to work with her that I didn’t take the time to ask enough questions. We met for less than 30 minutes and it wasn’t a great experience but I thought she was just having an off day. She said in order to hold the day she needs a save the date retainer of 50% down. We paid. At no time during this process did she say this was non refundable.

During the tasting she said she would send us the contract to review. I emailed her today to ask for a contract. In the contract it states that our deposit is non refundable but she didn’t present a contract for signature. The save the date retainer was actually the deposit. There is a place to sign on the contract but obviously she didn’t have us sign it. We really thought we were simply saving the date. I no longer wish to work with this vendor because I don’t think it is going to be a great experience, but I think it is safe to say we will have to forfeit our deposit. We have booked two very important vendors and have poured over their contracts extensively and I don’t know why we dropped the ball on this vendor. All advice appreciated and welcomed.

    Well you never signed the contract from what I understand? I know the stress with this. We were getting married in our home state and had the photographer, dj and baker booked but we decided to have a destination wedding at Disney! If you’re not feeling her see if she will refund your money since you haven’t signed anything. She doesn’t have anything saying she can keep it.

    If you didn't sign the contract and she never said it wasn't refundable than she can't deny you your money

    Thank you Summer, I agree. I just hope we can work things out with her. I’m so happy to be marrying my best friend but planning a wedding is so stressful.

    Oh, no! I hope you can get your money back. I met with a baker that told me up front that to hold the day, there is $125 non-refundable. It's too bad she didn't communicate with you. I would not want to work with her either.

    Can you stop payment on the check or dispute the credit card payment? If she has the money, it's unlikely you'll get it back.

    We paid with a credit card. We could give this a try. We are thinking if she refuses to refund the deposit. We are going to change the design of cake to include the deposit and donate it to one of our charitable organizations we support. I want to take this negative experience and make it a positive experience. I just don’t want her to be a part of our day.

    I would contact her ASAP and since you haven’t signed the contract there is nothing binding you. If she didn’t mention it was non refundable should give you your money back. Good luck

    It's challenging to remember your own name during planning let alone to ask all the right questions at the right time. It stinks she didnt go through her own checklist of questions & have a contract on hand for you to read before accepting any payments. Request your money (answer is always no if you dont ask), if she doesnt return it, maybe she can make you a small cake to have for your 1st anniversary.

    Since you didn't sign a contract, you should have a good chance of backing away from this vendor and getting your money back. Wishing you the best of luck!

    Wish you luck I love the idea of donating to charity! but she should give you your $$ back as there was no contract.

    This is how I lost my original cake deposit.


    Depending on the state they have no obligation to return the money because you never signed anything saying what the money was for (unless you signed a slip the day of). This means when you don’t return the contract or call to remove your name from the date it guarantees they still make some money. I contacted our lawyer and they said we weren’t likely to return the money because the baker could always say it was payment for literally anything else since we didn’t specify what the money was for (by handing over no money with no agreement there’s no way to trace the intent). Obviously you can ask but it’s not likely you’ll get your money back.

    Thank you all for your feedback! I was informed via email by the baker that we had 30 days to cancel her service and to get a full refund. We have cancelled and are awaiting our refund.
