Non-refundable Deposit

I planned my wedding for 6/13. Although the plans have changed (location, guest count, etc) we are still getting married on 6/13. I live in PA and my county will be in the yellow phase of reopening on 5/15. In the yellow phase, all non essential businesses can open provided they are able to perform social distancing; in store retailers are open with a limited number of customers; groups <25 can gather; childcare is open with certain guidelines. The only businesses that are closed are personal care (hair salons, massage, gyms etc) and entertainment (movie theaters, sports arenas etc). My photographer is saying it is ‘illegal’ for her to work until the county turns green, which likely won’t be for a long time. She’s refusing to return my non-refundable deposit. I do not agree with this. I didn’t change my wedding date or time. My wedding follows CDC guidelines. AND I don’t believe that she is restricted from working in the yellow phase. Is anyone else running into anything similar and has advice? I sent her an email asking for documentation that says she’s not able to work in the yellow phase and she ignored me.

    My photographer is in Pennsylvania and she just started working again. She wasn't working in the red phase, but now that her area is in the yellow phase she resumed working.

    I think unfortunately there's not much you can do since it's her business and her risk. Sorry this is happening to you.

    Would it be possible to use the deposit for a future photo shoot like for Christmas or something special instead of losing your deposit complete?

    That would be nice, however she didn’t offer to use it towards another event. And at this point I’m upset about the way she handled it and I don’t want to work with her again anyways.

    I feel you. One of my vendors refused to work with us on our postponed date and was being rude about us changing the date because he plans on working in July, we probably will have to fire him and lose the deposit. I just hate vendors are being selfish and not caring about customers.
    Can you dispute through your credit card or something?
