Out of state vendor charging sales tax in NH

Alex, on April 5, 2017 at 5:58 PM Posted in New Hampshire Planning 0 10

Hi Ladies! I am in a bit of a pickle and I can't seem to find the answer on Google, so I am hoping one of you has experienced something similar. I live in New Hampshire and my wedding will be taking place here. NH has no sales tax, which is great. I am looking to hire a fantastic videographer that is based in Rhode Island, which has a 7% sales tax. In all my prior experiences, any services rendered in NH, regardless of the vendor's home state were NOT subject to sales tax. Nothing tangible is going to be passed between hands, everything will be digitally provided.

Some other things to consider... my wedding planner is based in Massachusetts, which has a 6.25% sales tax. Same with my photographer, but neither of them are charging sales tax.

Any help would be appreciated!!

So I guess I don't know vendor wise. But assuming these vendors are businesses, if you buy from a business, you typically pay their state's sales tax... at least that's my experience.

^^I will second what Sarah said though. None of my vendors, besides venue with food/drink, itemized it. Hmm.

My wedding was in NH and I didn't get charged a sales tax for my vendors out of Boston. It might just depend on the vendor and how far they're traveling, their expenses etc. I think they're allowed to charge the sales tax because they are originally from there.

Travel and expenses have nothing to do with sales tax.

I'd be a pill and call your state office of taxation.

Actually you shouldn't be paying sales tax for thing delivered to another state. Like with online shopping you only pay sales tax if the item is also coming from your state. If it is out of state you do not pay sales tax on it.

Since his services are being provided out of state and he is providing nothing tangible you should not be paying sales tax. It is actually a line deduction on his BOE filing.

It does depend on the vendor, they are allowed to charge based on where they are from, but also allowed to wave it if the purchaser is from a tax free state.

OP I'm also getting married in NH but live in MA. I'm not sure about the taxes but would love to know.

    Also where is your wedding?

I am getting married in Michigan and my photographer is from Ohio. Because my wedding is happening in Michigan, we don't have to pay Ohio sales tax. I would assume the same would apply for your situation.

Thanks everyone for the help!! The general consensus is that I should NOT have to pay sales tax. I did have a friend who was married in NH and used a MA videographer and was charged tax. But instead of trying to argue the point with the videographer I have just decided to use someone who is local. The quality of work is on par with the original vendor, but the package is better and will end up costing less overall.

Also, Jen, I am getting married at BVI in Bedford.

I know this thread is old... but Just to educate everyone here and people in the future reading this...

If a business is based in a state with taxes, the work performed by the business is subject to taxation regardless of where the actual service takes place.

All of you saying your vendor didn't charge tax, trust me they probably did and just included it in the package price so as not to confuse you with numbers. At the end of the day, they will still have to file taxes on all they work they did and it will be taxes based on the regulations in their home state.

(I am an actual photographer in the New England area and I travel throughout the states for gigs but include the taxes in my package prices so that clients only see one sum)
