Photographer and officiant question regarding photos

C, on March 23, 2020 at 9:06 PM Posted in Planning 0 4

Hi everyone! I have a question regarding copyrights on photos, etc. My photographer, in the contract, says that they have business rights to the photos taken - we have personal use for printing and for posting online if we tag the company. My officiant's contract says that they will need at least one photo to use for marketing purposes. Has anyone else run into this issue? I'm thinking we can have a parent snap a photo of us if necessary (but we want a "disconnected" ceremony - so no phones or anything) or we could ask to buy the rights to just one photo maybe?

I would maybe talk to your photographer and see what they say? I know nothing about copyright laws, but if you ask for permission, they may allow you to send your officiant one that has a watermark on it or you could potentially buy the rights as you said. I think as long as credit is given to the photographer there shouldn’t be an issue? But like I said, I know nothing about copyrights. If for some reason your photographer won’t allow it, I think it would be okay to allow one of your family members or friends take a few quick photos from their seat and just try not to be too obvious. 😊

My photographer had a similar statement in her contract. She just asks that the other vendors credit / tag her on social media.

Check with your photographer. It’s becoming much more common that ever vendor expects access to your pro photos to use for their marketing purposes. I think in the case of a vendor using a photo for marketing, if the photographer is willing to share it makes sense that the photographer include their logo or watermark somewhere on the photo.

I agree with the others that it's best to just ask your photographer and see what they say. They may be happy to provide a photo at no additional charge as long as the officiant gives them photo credit when it is used. If they aren't willing to do it for free, maybe they will for a small fee. It doesn't hurt to ask! Smiley smile
