Question about Buffet Leftovers

We are having a buffet, and I had wanted to donate the leftovers to the local soup kitchen. (I used to help there every morning before school.) I asked and the caterer said that they will make take home plate for FS and I, and our parents and that's it.

She said the reason is if someone left it in their car and then got sick from eating it, they would be responsible. So they don't allow it because of liability. This makes no sense. If I take leftovers from a restaurant and eat them after they were left in my car for days, it is my fault for being a dumb a$$ not the restaurant's fault.

For those that have had/are having buffets, were you allowed to take the leftover food that YOU paid for?

Thank you idk what people don't understand about this. Nobody is "re selling" that food unless they don't care at all about repeat business or reputation. Also there are times i go over just to ensure that there is enough food i do this to benefit the client so if they say 100 guests and by chance 110 show up there is food at MY costs because i don't ever want to point fingers at a client about them allowing the extra people or discount so to ensure there is enough food I always go over 5-10 out of pocket because i don't want to be the caterer who "ran out of food" because no matter the circumstance it would look like the fault of the caterer so I do this to ensure my own reputation and never argue with a Client so ppl don't think about those kinds of things either that NO you probably didn't pay for all that food at a buffet style event.

I recently ran into this issue as well. It was a restaurant that catered it. The guy told me the same thing and I said if I eat at your restaurant but cannot finish my food, do you not offer me a to go box? I am hard pressed to see the difference.

Since it wasn't a buffet they can send the left overs home. Buffer food cannot be per health code and for liability reasons. There are strict time and temperature controls that must be followed and by the time an event with a buffet is over the time and tempature controls have been succeeded.

Because an entree from a restaurant doesn't exceed time and temperature controls of the US Food Code and local health departments whereas buffet food does.

Not from buffets. The food has exceeded the time and temperature controls of the US Food Code therefore its not safe or wholesome. There are very strict guidelines that must be followed with food safety.

Buffet food is not safe or wholesome as it exceeds the time and temperature controls set by the US Food Code. Therefore it cannot be given away to take home or donated.

I agree. If you order drop off catering from anywhere, they don’t stick around to tell you that you have to toss it out as soon as the last person goes through the buffet line. But everything does need to be kept at proper temperatures for food safety. As long as someone is on hand to oversee that, you can do whatever you want with it.

Yet countless hotels and restaurants serve buffets every day with no issue and they are not permanently shut down, because they adhere to local food safety laws. A number of catering companies serve buffet only because they don’t have access to full kitchens or capability to cook for 100+ in a very short window of time. They take food safety very seriously because they would be shut down permanently if they did not. Many donate food every day without a single issue.
