Refund? covid brides and attorneys

Attention: COVID brides and attorneys

Quick question in regards to forced COVID-19 rescheduling (Wedding date 05/03/2020), our venue is adamant about a reschedule despite us requesting a full refund due to the current circumstances. At this point the venue that we chose is too big for the type of wedding we are probably going to have due to COVID-19. A lot of family would be traveling and at this point those traveling family members and immune compromised guests will probably not come, so this will significantly cut our guest list making our venue that we originally were going to go with unreasonable. On top of this, the government has mandated no gatherings of 10 or more? Part of the contract states that due to an act of God we can CHOOSE to not reschedule and get a refund... Is this not enough to get a refund when it LITERALLY says exactly what we are requesting?


This is exactly what the contract states below:


"Venue shall not be liable for consequential damages of nature for any reason including but not limited to weather or other acts of God, government authority, malicious damage, etc. Should an act of God or emergency make it impossible for the facilities to accommodate your guests, your event may be rescheduled, however should you choose not to reschedule we will provide a refund."

    The way I read that excerpt, it would state that if THE FACILITY were to be unable to host your wedding (i.e. a fire, major natural disaster, etc.), you could choose to get a refund instead of rescheduling. However, since the facility can still host your guests, you would not be entitled to a refund. While you think the guest count will be lower due to COVID, a lower guest count would not be covered for a refund in the contract.

    Send an email asking the venue whether you are able to host your wedding on your contract date with the amount of guests listed in the original contract. If they said no we are unable to host your event due to the current shut down orders in stated by the governor and the current cdc guidelines. Then respond back, pursuant to section xyz in the contract, we would like to request a full refund. See what they come back with. What state are you in by the way?

    Unfortunately I don’t think covid 19 is considered an act of God in terms of contracts.

    I read it the same as the others. If for some reason the facility is unable to host your event, then you could choose to cancel for a refund. Unfortunately I don’t think they will be obligated to refund anything due to the virus. We had to postpone from May to August, and all of our vendors were willing to reschedule for us with no penalty, but only one was willing to refund, which wouldn’t have done any good anyway. Sorry you’re dealing with this! Best of luck as you navigate through everything.
