Second Deposit due-what did you guys do?

Hey guys!

Another NJ bride here trying to navigate planning my wedding with COVID.

My date is in March 2021 and our second payment is set to be due soon. This second payment is a lot of money and we are very hesitant on giving that money to our venue after hearing some class action lawsuits coming out. We spoke with our venue and they are very adamant on having us pay despite them not even being able to host weddings yet. I tried to negotiate giving them the second payment once they are hosting weddings again because as of now we don't know if they would be able to follow through with the contracted wedding agreement. We are worried on essentially being robbed of this money in case we end up having to re-schedule and only being given a weekday or forced to pay even more money for a Saturday at a later date.

What have you guys been doing? Have your venues let you hold off on making additional payments?

    Hi Alana! It all depends on the terms of your original contract, and that's will hold up legally. I definitely understand your concern with additional payments though.

    Have you talked with your venue about what future postponements would look like? Is there anything in your contract about rescheduling fees? Having a clearer vision of what plan B could look like might be helpful!

    Hi Lynnie!

    Thanks for the resources! Unfortunately, our contract does not include anything about rescheduling. We are hoping to have a meeting with the venue to write an addendum that both parties would agree upon in case re-scheduling is necessary. Fingers crossed they would be agreeing to it!

    If your venue is closed and are not operating at the moment, they should not be asking for payments. My friends venue (in NJ) said its okay to not pay payments at this time because they are closed. Her wedding is supposed to be in April.

    Unfortunately I don't think this situation will go away until 2022, IF that. Until then I imagine weddings requiring mandatory masks, social distance (which doesn't work for weddings)...whenever Murphy announces it is acceptable to host weddings with no limited capacity.

    Most NJ venues are asking to pay 2021 pricing if you reschedule, which is ridiculous as COVID was not under our control.

    Thanks for the information. Unfortunately, my venue has been TERRIBLE with any sort of remorse. I even offered to pay more money for rescheduling to a 2022 wedding and they won't budge. They are set on having us pay for a wedding that most likely won't happen. The only option I have is to fully cancel and lose a lot of money on our initial deposit, but at least we won't be putting in all the money in our budget with this next payment. what is your friends venue? I would love to give them my business when I choose to reschedule my wedding.

    Does your contract have a force majore clause? Closure due to Act of God? You certainly should not be paying for something that is not guaranteed. That is just insane. I would have to get back to you on her venue, completely forgot the name. She is canceling her April 2021 wedding.

    We have that in our contract, but they are telling us it only applies 4 weeks before the date and we have the option to re-schedule 8 weeks before our date. Neither 4 weeks or 8 weeks are in our contract-they just came up with those timelines and are holding everyone at the edge of their seats. We wanted to keep doing business with them, but they are being ridiculous. Unfortunately, we are most likely canceling.
