So, i started contacting cake decorators in search of the perfect one to make fh and i's hellraiser puzzle box wedding cake.....however in my search never did i expect this hysterical reply from a cake decorator, feast your eyes on this gem:

"I'm sorry I wouldn't be able to create a cake like the Hellraiser puzzle box, it would be a violation of copyright / trademark laws."

umm....seriously??? how many friggin disney cakes have you seen out there? or harry potter cakes etc.....what in the actual f*ck lol

    I would give Haute so Sweet a try.

    Oh and since you can completely get away with it, don't advertise it as a wedding cake, you may save a few bucks.

    Aww thank you annie....and i too have the unhealthy obsession...well and i think pinhead is the sexiest character ever hahaha. i might have to do a display cake if my luck keeps as is, some bakers say they just cant do it justice and some cry copyright lol im at a loss here i really really dont want a typical wedding cake

    Uber Dami, I understand your frustration, but just because they do cakes inspired by Batman, Disney and video games does not mean they are able to adhere to every request. Those characters have already been released and the/she has purchased the cake pans and has made cakes in the past.

    Maybe respond and ask if there's anyway to obtain the rights so that the cake can be made.

    They dont use cake pans to mold the characters out of fondant but ok. im not going to be hunting around to contact the original artist of the puzzle box, that just seems a bit overboard honestly. im sure ill find a capable baker whos willing to make the cake.

    Annie unfortunately in the link you sent me, they say they need 6 months heads up when ordering a cake, we dont have 6 months Smiley sad oh well

    Kit at this rate i wont have the cake, my hair done, my dress done etc.....its become a royal cluster f*ck and ive had no luck really

    Uber Dami - I think I remember a post awhile back that you were looking for a red and black dress for your wedding and your FH accidently saw picture of your dress. Did you find another dress for the wedding or did you end up staying with the original? Sorry if I have you confused with another bride :-)

    Kristin it was my post you're correct, i found the dress, a week later i was unsatisfied with the dress so ive been working on a sewing project trying to add to the dress to make it more likeable. its a good base, it just needs more oomph, luckily i make a lot of my own clothes so it shouldnt be too difficult, i just have to somehow find the time and energy to start recreating it

    I'm with KitandKaboodle. It is frustrating, but the laws of copyright are murky. Some licensing is allowed by certain companies and some isn't. It really depends on the laws, the date of copyright, and a host of other things. Some bakers and bakeries buy specific licenses to recreate disney, batman, video game related cakes they might not have a license to recreate the cake you want depending on their licenses with particular companies or if there's one available. Depends on the copyright status of the image. Some images are also Creative Common therefore they are allowed to be used.

    At my work. We have a list of movie companies that we can show - if 20th Century Fox isn't on the list we cannot show any of their work, but we might be able to show Dream Works if they are on our licensing agreement. Some also pay to be the only company allowed. Again, murky.

    Sooo I don't know what a hell raiser puzzle box is so I googled it. If I saw a cake that looked like that I'd have no idea it was from something specific, in fact I'd just think it was some cool design from maybe a specific heritage. So I seriously don't think the bakery would get in trouble for it because I can't see anyone challenging it. Especially if you came up with the design. So yeah...sounds like a lame excuse to me.

    I'm so sorry you're having such a hard time bringing your vision to life. It just shows that you are unique and you should be proud to not fit into the cookie cutter mold of a bride. I'm sure it is definitely challenging to find the things you want, and you're definitely having a harder time than those who just say they want a cake with flowers on it, but in the end it'll be worth it for you! Good luck bringing your vision to life, I'm looking forward to seeing it!

    @Kristin, they purchase the rights of the character's license. In order for a costume company to sell a costume in the likeness of Barney, they have to purchase the likeness. If they do not, they are infringing on the trademark/copyright and will be sued. Now, there are ways around that. If the Barney suit is not purple, no law has been broken. It's when the suit is purple (any shade of purple) then the seller has broken the law and is open to a huge lawsuit.

    A lot of bakeries recommend ordering in advance, I usually suggest to my clients to book at least four months in advance, shoot them a quick email and see what they say, they may have wiggle room.

    It's funny your dress was brought up. I saw a fitted, red dress at the salon I bought my gown at and thought of you! Are you still going with the gown your FH seen and asked if you had bought it for an award ceremony?

    Just because many bakeries violate copyright laws doesn't make it legal. And the bigger the bakery, the more likely they are to get sued. If this bakery is making Disney cakes but refusing to make a Hellraiser cake, you can accuse them of hypocrisy. But if this bakery is merely being more ethical/legal than its competitors, and refusing to make cakes with any copyrighted/trademarked images, they should not be blamed.

    Not too sure how far into CT you are, but try Blue Sheep bakery in NJ. It's not the closest, but they def deliver and I'm sure she would totally love to make a cake like that for you. They made the cast party cake for the living dead. It was this crazy zombie. I'll have to post a pic. Yummy cake too!

    Having worked with copyright laws for a very, very long time, you don't understand the gravity of what you are asking a private individual to do. You would not be the one being sued--they would.

    Either find a friend who doesn't care about copyright, intellectual property, and trademarks--or is too dumb to know the laws--and have them make the cake. Or pick another design.
