Hi

So I am currently looking to cancel my DJ due to lack of professionalism and fraud essentially, I just don't know how to approach it. Basically, I sent him the contract and the check (written by FMIL) and asked for an invoice so I would have it in my records, his "invoice" was a picture of the check and signed contract. The second and much bigger issue is about the check, he cashed it via mobile deposit on Sept. 1 and this past weekend my FMIL informed me that on Oct. 13 he cashed it again at the bank and you can see from the scanned-in check that he crossed on the mobile deposit note that he had written on it, thankfully she got refunded for the second cashing and obviously I no longer want to work with him. I just have no idea how to approach this. Has anyone else run into issues like this and had to cancel a shady vendor?

    Maybe the bank can return the other money to your FMIL. The basis would be the suspicion that this was not mistake. Also, the service has not been done yet, so the DJ only loses money for possible future work. Then the DJ has to get your confidence back to keep that agreement funded again.

    Thankfully she got refunded for the second time he cashed it. I am under the assumption it was not a mistake, as we crossed off the mobile deposit note he wrote.

    Right. I saw it was for the second time. But the first one should be revoked, especially with that evidence of the mobile note being crossed out. He would not likely try to uphold the contract in court with that evidence in your hands.

    His action may be a form of securities fraud. That could be a nasty state case against him. (But you cannot threaten him with that to compel him to return the money. That could be illegal.)

    Just a thought... The picture of the check and signed contract, on the other hand, might suffice in the role of the invoice. He has associated the two by doing this. If he is an independent operator, he may do things differently than a "normal" business.

    This is a big assumption. Did you contact the vendor and ask what happened? Are there any reviews or history of this type of behaviour? Is it possible it was just an error?

    Unfortunately it’s not just an error because with our bank PNC we can see the scanned in checks that are cashed and on the second time he cashed it he crossed out mobile deposit note on the endorsement line and initial the change when he cashed it in person

    As far as firing him, You can just send an email saying that in light of recent events with him trying to cash the check twice, you don't want to work with him.

    I personally would also ask for the deposit back, but he probably won't considering he was already trying to scam you for more.

    Anyway, I'd also post a negative review on google/yelp/etc.

    I wish that worked. He denied it every step of the way and fought us trying to cancel.

    On the side of caution, he could have thought it was a check that he was going to do electronically and thought he had not done that. But if he did not admit this to you, it speaks against that interpretation.

    Oops. I see he continued to behave improperly.

    I know he can't force anything he was just relentless to the point where I had to block his number because he wouldn't stop calling after my fiance spoke with him and he wouldn't stop calling after my fiance made it clear we were done. It's just frustrating.

    That is not normal behavior. I would file a harassment complaint with your local PD, and also mention in the report that this man fraudulently cashed checks in an attempt to steal from you before starting to harass you by phone. You could also serve him with a cease and desist letter.

    Oh no I'm sorry that had to you and if was a good thing that the bank. Seen the error and refund your in laws their money back. So the bank seen the markings when he was trying cash it the second time. See with mobile banking they tell you that you have to put void on the check. Meanwhile it was cash already so he was trying to write over it and tried it at actual bank. I'm surprised that the teller didn't get a manager involved. Now as for the contract do you have a copy of it now the only way that you can bring him to court is if he brings up again for another payment. And tell him that you have received a call from the bank about trying to cash the check a second time. Then you can say that you want out from this contract because he breached the contract so you can looking some others.
