Vendors asking for more money to postpone

Shaylyn, on April 9, 2020 at 10:56 AM Posted in Community Conversations 1 7
Hi everyone, I hope you’re staying healthy and safe amidst the current situation.

My fiancé and I are supposed to be getting married 10/2/20. Some of our vendors have reached out to ask if we are planning to postpone. As of right now, we are moving forward as scheduled but I’ve been asking the vendors what would happen in the event we need to postpone.
Many of the vendors are giving us limited options (we would have to postpone to winter 2020/2021 or have a weekday wedding) or charging a postponement fee if we move our wedding to a Friday in October 2021.
We’re not going to have a winter wedding (our venue is outdoors) and we don’t want to have a weekday wedding since the majority of our guests are from out of town. We also don’t have more money to put into our wedding as our pay has been cut by our employers due to the pandemic.
How are you handling vendors who are asking for more money to postpone?

    Hi!

I’m so sorry to hear you’re going through that! Have you thoroughly read the venue’s contract? Would it be cheaper to just change the venue? My fiancé and I postponed our May wedding to October 4 and we don’t plan on moving it again. I’m surprised your venue is asking if you’re considering moving an October date..

We are in the process of gathering this information as our wedding is scheduled for 10.10.2020. Our venue requires a $500 postponement fee but they said they’ll be willing to work with us on the payment rather than paying it up front. I’m still waiting for our florist to advise what their policy is as the proposal we accepted doesn’t have any details. Hair and make contract is a little more strict saying they aren’t responsible for acts of god and if we cancel we lose what we’ve already paid (retainer and quarterly installments to pay off the final balance). Holding they work with us considering the circumstances but who knows.

What we are finding when speaking with people is that the venue does not charge fees if THEY make the decision to postpone it. We are waiting for ours to make that call as a result.

What about vendors? Our videographer is trying to charge us a 25% re-booking fee ($1383) if we re-book for a Friday in October 2021. (no re-booking fee if we re-book for any time before April 2021 or a Sunday after April 2021).

Our venue contract states we would lose our $4k deposit if we were to cancel/reschedule but it doesn’t say anything about what would happen in the event they had to cancel or the wedding couldn’t take place because of an “act of God”. I was looking into hiring a contracts attorney but he wanted $2900, which I can’t afford.

Hi Shaylyn! Every vendor is handling things differently right now, and it definitely depends on your original contract! The "act of god" clause applies to natural disasters (hurricanes, earthquakes, etc) but not the current crisis - unless your contract specifically mentions something about a pandemic or government closures.

It sounds like instead of losing your $4k deposit for rescheduling like your contract states, your venue will let you proactively postpone (with an additional fee for many dates). How much is the postponement fee?

You could also monitor the situation and wait to make a decision until closer to your wedding date (shoot to re-evaluate in August). If the local guidelines against gatherings continue and look like they will still be in place for October then the discussion with your vendors will be very different!

Please do not listen to the above comment by Lynnie. Our attorney went over our contract, and acts of God is a "force majeure" which certainly does cover the current pandemic. If the contract does not say that you will be charged a fee or extra deposit for rescheduling your date due to acts of God, then you should not have to pay a dine. These vendors and venues are taking advantage of the situation by extorting and forcing couples to pay a fee in order to move their wedding date. Know your rights!
