Venue refusing to refund: Oahu, hi

My fiance (now husband) and I were planning on getting married on Oahu, HI this past Sept but due to covid, we shifted plans and got married in a small ceremony here in California. The venue that we booked is not cooperating with us and telling us that they cannot provide a refund at this time because they are under water and whatever funds that they received they are using it to maintain the property. They are offering to not charge us a change fee to move back the date (which we don't need since we already got married) or give us a voucher.

Considering that Hawaii has been on lockdown a few times and there was no way that we could have traveled there without quarantining for 14 days and large events could not take place, how is this ok that the venue won't even cooperate?

Has anyone been in the same situation here or dealing with something similar?

    What does your contract say? Generally deposits are nonrefundable. They have offered you the option to change the date, which is generally the best people have been able to get.

    I would suggest talking to a lawyer, but I would be surprised if you could get a full refund.

    There are a number of issues going on here, I would reach out to management and let them know that due to the Covid restrictions and inability to hold an event at their location you just want a refund. You understand their predicament and it’s unfortunate, but you too have been through quite a bit and that money is needed to now help you maintain your living expenses. Ask them what do they need to do to refund you and how can you help? Refund in installments? Be kind, be stern.

    I totally agree with Margaret! The refund in installments is a great idea (maybe every other month or even every month until you are fully reimbursed). If they agree to either option, definitely get it in writing.

    It sounds like they are being completely transparent - they literally cannot pay you back. Cash is a major issue for resorts right now, especially in places like HI for exactly the reason you stated above, no one can go there.
    Check your contract, but assuming you are not guaranteed a refund (because it seems that most don’t) then you have 2 options: ask for something they can provide or forfeit the money. If there is no way you will ever use a credit at the resort, even for a honeymoon or other, ask if they will agree to refund part or all at a future date. This of course depends that they don’t go under, but they may be willing to offer partial refunds once solvent again.

    You would need to read your contract. I have seen a lot of brides post about not being able to get their money back because their contract states that the money is non-refundable. Since it sounds like they are going under, they likely don't have the money to give you back so there really isn't much that can be done even if your contract doesn't mention that it's non-refundable.
