Venue selling

I previously posted about my venue being for sale. The owner cannot guarantee me my wedding date or anything. She states she doesn't know the answers right now.
Well, I have started looking for backup venues with intentions of booking one if we find one we love.
So today I message the owner and ask about the cancellation policy due to the venue being for sale.
She says that I would be responsible for the entire cost, unless they rebooked. Which- yes it does say this in the contract- but you would think that would change once a place is put up for sale? So ultimately now she CANNOT guarantee my wedding date and venue, but CAN guarantee that I will owe $$.
Guys I have cried so much.I’m struggling so hard to decide on what to do.

    Wow. There are no words. Do you know any lawyers in your family? I, like you, would think that when the party you signed the contract puts the venue up for sale it should negate the contract. I’m not sure what they gain by holding you to it, other than using it as a negotiating tool when selling which is wrong on every level.

    What makes this even worse, is that we already have two other vendors booked. So I need to find another venue with the same date open- which happens to be nearly exactly 1 year from now...

    If they are holding you to this contract, then they need to be accountable also. You have a signed agreement for your wedding date, and if they can no longer follow through, it sound like they are in breach of contract. If anything, I can see them keeping your deposit, but you should not be under obligation. And I would also think the new owners would be obligated to your agreement also. Granted, I am not a lawyer, but I do have a business background, and they are also obligated to the agreement.

    Whoa .... not sure she can do that! I’m glad to hear the contract is. Ring looked at. I would definitely keep a paper trail of everything, no phone calls, and fight this if you end going elsewhere and she comes after you expecting payment if she is unable to guarantee your wedding date. What is typed will be very important. Document.

    I have only communicated via text to make sure I can save everything. She doesn’t use e-mail communication so this is the best I can do..

    That’s absolutely ridiculous if you’re not having a wedding there because of their business failing why should you have to pay a fee. Do not give them another dime. I’d take this all the way.

    Disclaimer: I am not a lawyer.

    But I am pretty sure that if she can't guarantee she can provide the services you have paid for, she is required to give you your money back. She either has to guarantee that your contract - that is, that you will be occupying that venue on that day - is valid, or she has to give you your money back.

    It sounds to me like she's trying to have her cake and eat it, too - she's trying to get money from selling the venue and hold brides who are in the same predicament to that contract so she can keep their money if they cancel.

    I am assuming you can't afford to simply wait it out.

    I hope your father's lawyer can offer some insight, because this is SUPER shady.

    So in short everyone- my lawyer said that if I were to take it to court I would lose. So I get to spend the next year hoping and praying it all works out.
