Wedding lawsuit due to pandemic

Any brides have their venue cancel due to COVID restrictions and then try and force you to choose a new date? I’m currently seeking legal counsel. I’m curious if any other brides have filled lawsuits and how it’s turning out for them. I’m completely lost and devastated my dream wedding turned out...

So they’re entitled to keep our 25k because the state gave a mandated order and they were forced to cancel our event?

Thank you for the prayers. None of this is fun!
Where are you located? Be cautious. And mindful about your wedding being days after the election... Washington post just wrote an article saying the election will end in violence if Biden doesn’t win.

    About what part?
Our state isnt “shut down” but our mayor decided to shut it down for personal reasons.. she was caught in a nail salon in march.. made national news... so she is trying to save her career by shutting down an event center that is owned by the city. Breaching contracts.

There are only 2 hospital in my town & I work at one. The local ... along with other reports have been wrong with the numbers.. they reported more numbers than we had beds back in march. Now its finally made the news that only 6 percent of the numbers are right. I was very concerned about it at first and I know some people with under lining issues should, but the flu still kills more people today. Yesterday china had no reports of the virus? Idk but its all adding up yall.
So. Yes Id definitely get that lawyer. They cant keep your money and not give you the date you asked for

Id consider it too.. there are stories of people taking babies away saying they have covid, ect and you cant do that.. you cant force someone to get tested, its your right!! Actually yes, we are 35 miles from where it got bad. Thank God we only lost power for a few days & were able to evacuate safely. Hurricanes are the absolute worst!!! Where are you?

You realize we’re in the middle of a pandemic and their are multiple brides on here who not only lost their “dream wedding date” but also their entire deposit and then some. You are one of the fortunate ones that was actually able to keep your venue but also the money you spent. Let’s understand that venues and vendor are filing for bankruptcy ever day.

The only reason you’re out 25k was because you didn’t want to reschedule your wedding during a pandemic and state mandated orders

Most of the deposits and payments for venues state that they are non-refundable. Even during this pandemic most venues don't have to offer you a full refund because just like it's out of our control, it's also out of theirs. I would definitely re-read the contract because unfortunately many vendors won't have to offer refunds.

If you have spoken with a lawyer and they are saying that the venue has breached the contract that y'all signed then of course follow through with it and get that money back girl! Yes this is a pandemic and times are crazy, but that is a lot of money and I would do the same thing if I was you! Especially if a lawyer told me I was in the right to ask for my money back! I hope it works out for you! Congratulations on eloping and the baby on the way!

I'm a lawyer here in the US. Misconception about force majeure/act of god...its a defense to contract performance. And it exists in most states without a written contract, i.e. a party can raise it as a defense without having an explicit force majeure/act of god provision in a contract. For example, you file a lawsuit for breach of contract, the venue raises force majeure/act of god as defense. Due to the shut down in TX, government regulation prevented the venue from fulfilling the contract. That event (the shutdown) was completely unforeseen to a reasonable person when both parties signed in the contract. Therefore, force majuere prevented a party from performing the contract and you lose. It does depend on the terms of your contract, in particular what it says about a deposit and whether the court will allow outside evidence. I haven't read your contract, and this is not legal advice, only an explanation. I've been tracking a lot of these covid cases as part of my work and working a lot of act of god/force majeure contract provisions for my clients. If another lawyer says they breached the contract, then that lawyer has an ethical responsibility to think you have a case. But the venue also has several defenses at its disposal.

Crystal, I hope you get your money back! I would also be trying to seek legal advice. If the lawyer says you have a right to that money, or at least something, I’d try! I’m not sure why “trying” has created so many negative reactions on here lol. I personally am not in this situation, yet. I’m very fortunate that my contract is very clear, and the contract states they have to return 100% to me if acts of god prevent them from hosting the event. Good luck on congratulations on the wedding, and upcoming baby girl!

Idk why folks are arguing this (on either side), for what it’s worth get your lawyer and see what happens. Also let us know the outcome because this could be a game changer if you are entitled to a refund.

Why would I reschedule when I’m already married? Who in the world pays 25k for a vow renewal? Also, you nor them know my financial situation or what we are personally going through with this pandemic. Absolutely no way they’re entitled to my money when they couldn’t perform the service we agreed to.
